1. Introduction

Feel Better Pilates understands how important your privacy is. This privacy policy (the "Privacy Policy") sets out the privacy policies and practices for Feel Better Pilates (operated by Jordana Martin and its affiliates (collectively, "Feel Better Pilates", "we", "us")) with respect to how Feel Better Pilates collects your personal information. It also describes how Feel Better Pilates maintains, uses, and discloses personal information. This Privacy Policy applies to information collected from you by Feel Better Pilates via the Site, in our studios, and through our booking and communication platforms. This Privacy Policy also sets out how you can access certain information that Feel Better Pilates may collect about you.

In this Privacy Policy, personal information means information about an individual whose identity is apparent or can be reasonably ascertained from the information, as further defined under applicable privacy laws ("Personal Information"), and is handled in accordance with the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth), as amended.

Please note that the Site may contain links to other third-party websites that are not controlled or operated by Feel Better Pilates. All of these third parties are listed in Section 6 of this Privacy Policy. This Privacy Policy does not apply to such third-party websites, and Feel Better Pilates is not responsible for the content of such third-party websites or the privacy practices of such third parties. Feel Better Pilates encourages you to request and review the privacy policies of any third parties upon disclosing your Personal Information to such parties or when visiting such third-party websites.

2. Minors

The Site is not intended for children under eighteen (18) years of age. No one under age 18 may provide any Personal Information to or on the Site. Feel Better Pilates does not knowingly collect Personal Information from children under 18. If you are under 18, do not use or provide any information on the Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of the Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If Feel Better Pilates learns we have collected or received Personal Information from a child under 18 without verification of parental consent, we will delete that information. If you believe Feel Better Pilates might have any information from or about a child under 18, please contact us at hello@feelbetterpilates.com.au.

Where a minor participates in our services with the consent of a parent or guardian, the parent or guardian provides that information on the minor's behalf and is responsible for its accuracy. Parents/guardians can access, correct, or request deletion of their child's information by contacting hello@feelbetterpilates.com.au.

3. What We Collect

3.1 Personal information

  • Name, email, phone number, date of birth

  • Emergency contact details

  • Payment information (processed by our payment providers - see Section 6)

  • Booking and attendance history

3.2 Sensitive information (health data)

As a Pilates studio offering clinical and rehabilitation-focused services, we collect health-related information, including:

  • Injuries, medical conditions, and physical limitations you disclose

  • Notes from teachers relevant to safe class modification

  • Information shared during intro sessions, clinical assessments, or private sessions

This is treated as sensitive information under APP 3.3, which requires your express consent. We only collect this where it's reasonably necessary to deliver safe, effective instruction, and only with your explicit agreement at intake (via booking form / waiver).

Storage and access controls:

  • Health information is stored separately within Momence with restricted access

  • Only teachers directly working with you, and admin staff managing your bookings, can access this information

  • It is not used for marketing purposes under any circumstance

  • It is not shared with third parties except where required by law or with your explicit consent (e.g. referring you to a physio)

3.3 Information collected automatically

  • Website usage data (via cookies - see Section 5)

  • IP address, browser type, device information

4. Why We Collect It (Purpose Limitation)

We only collect information reasonably necessary for a specific, stated purpose:

  • Name, email - account creation, booking confirmations, service communications

  • Phone number - SMS class reminders, urgent same-day schedule changes (e.g. teacher illness, class cancellation)

  • Health/injury information - safe class modification and instruction

  • Payment details - processing membership and casual payments

  • Emergency contact - safety response in the event of an incident during class

  • Website cookies - site functionality and, where you consent, analytics/marketing

We do not collect data "just in case" - if we're not using it for one of the above, we don't ask for it.

5. Cookies and Website Tracking

Our website uses cookies. By law, consent for non-essential cookies must be opt-in, not implied by continued browsing.

  • Essential cookies (site function, security) - no consent required, cannot be disabled

  • Analytics and marketing cookies (e.g. Meta Pixel, Google Analytics) - require your active opt-in via the cookie banner on first visit

You can withdraw consent at any time via [cookie preference link] or your browser settings.

6. Third Parties We Share Data With

  • Momence - bookings, attendance, membership details, payment info, health/injury notes, phone number. Used as our core booking and class management platform.

  • Stripe - payment card details. Used for payment processing.

  • Meta (Facebook/Instagram) - website interaction data (via Pixel, if cookie consent given); customer email addresses (uploaded, hashed, for lookalike/custom audience creation). Used for ad targeting, campaign performance, and audience matching.

  • Squarespace - website usage data. Used for website hosting and functionality.

  • Lovable - member email addresses and attendance/booking data, used for KPI analysis. Used for internal business reporting and dashboards.

  • Supabase - member email addresses and attendance/booking data, used for KPI analysis. Provides the database and backend infrastructure underlying the reporting tools.

Privacy policies for each provider:

None of these providers are permitted to use your data for their own purposes beyond delivering the service to us. We do not sell your personal information to any third party.

Meta audience matching: if you don't want your email address used to build lookalike or custom audiences on Facebook/Instagram, you can opt out at any time by contacting hello@feelbetterpilates.com.au - we'll exclude you from the next upload and request removal of your existing hashed data from Meta.

Other disclosure: we may share your information if we believe in good faith that disclosure is required to protect your safety or the safety of others, to investigate a fraud, or to respond to a government, judicial or other legal request or to comply with the law.

We may also share certain aggregated, anonymized information with a third-party provider in order to assist us in improving the Site.

7. Data Retention

We keep personal information only as long as necessary for the purpose it was collected, or as required by law:

8. Data Breach Notification

Feel Better Pilates has processes in place consistent with the Notifiable Data Breaches (NDB) scheme under the Privacy Act.

If a data breach occurs that is likely to result in serious harm to you, we will:

  1. Contain and assess the breach as soon as practicable

  2. Notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law

  3. Provide guidance on steps you can take to protect yourself

9. Your Rights

Under the Privacy Act, you have the right to:

  • Access the personal information we hold about you

  • Request correction of inaccurate information

  • Request deletion of your Personal Information - we will be happy to delete any Personal Information we hold upon a written request from you, and it will be safely disposed of, except where we're legally required or have a legitimate business reason (e.g. financial record-keeping, potential insurance claims) to retain it

  • Withdraw consent for optional data uses (e.g. marketing)

  • Lodge a complaint about how we've handled your information

Note: you may always refuse or withdraw your consent by contacting us at hello@feelbetterpilates.com.au. You understand that if you withdraw your consent, Feel Better Pilates may not be able to continue to offer its services and provide its information to you.

Feel Better Pilates will ask you to verify your identity when you contact us or submit a request regarding your Personal Information. We will ask you to provide sufficient information that allows us to reasonably verify that you are the person about whom we collected the information.

If you're not satisfied with our response, you can lodge a complaint with the Office of the Australian Information Commissioner (OAIC):

10. Changes to This Policy

We may update this policy from time to time. For material changes (e.g. new categories of data collected, new third-party sharing, changed retention periods), we will actively notify current members via email before the change takes effect - not just update the page silently.

Minor administrative changes (e.g. contact detail updates) will be reflected here with an updated "last updated" date.

11. International Compliance

Feel Better Pilates operates within Australia and is bound by the Privacy Act 1988 (Cth). We do not make specific representations of compliance with international frameworks such as GDPR or CCPA. However, we apply the same privacy protections in this policy to all subscribers and members regardless of where they're located.

12. Protecting Your Information

Feel Better Pilates is committed to protecting your privacy. We restrict access to your Personal Information through role-based access controls in Momence - only teachers and admin staff who need it to do their job can see it. Selected member data is also processed in our internal reporting tools (see Section 6 for the providers involved) for KPI analysis - access to these tools is restricted to those responsible for reporting.

13. Governing Law and Disputes

This policy and the use of the Site are governed by the laws of the Australian Capital Territory. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the Australian Capital Territory. If a dispute arises, we agree to first resolve it through binding arbitration to take place in the Australian Capital Territory.

14. Data Transmission

The internet is, by its nature, inherently open and subject to interception of information. We cannot guarantee that the information you provide to us over the internet or otherwise will not be intercepted by third parties while it is being communicated by means that are outside of our control.
